Seeking Compensation after a Jackknife Accident
A jackknife accident happens when a truck’s cab and load trailer fold in to form a “V” shape, taking up multiple lanes on a road or highway. These situations are often caused when a truck driver hits the brakes too hard while traveling at a fast speed. The truck may collide with traffic in other lanes as it jackknifes, and it may also cause crashes with vehicles behind it that do not have enough time to brake or otherwise avoid an accident. The pile ups that result can cause serious injuries and even fatalities.
If you or a loved one has been involved in a jackknife or other crash, you likely have the right to seek compensation from those responsible for it. The damages available in these cases typically include money for property damage, medical bills, missed wages due to time away from work, pain and suffering, and emotional distress, among other possible examples.
Jackknifes are often the result of driver errors, whether it be speeding, braking too hard, or other dangerous behaviors that cause the driver to brake at the last second. State law imposes a “duty of care” on truckers and other drivers, which requires them to operate their vehicles in a reasonably safe manner under the circumstances. A driver who fails to live up to this duty is likely to be considered negligent and held liable for any resulting accidents and injuries.
In truck accident cases, the driver’s employer is also often considered liable under a theory called “respondeat superior.” Trucking companies are generally liable for any accidents caused by a driver acting within the scope of his or her job. This would include accidents that happen while the trucker is on the clock. Some questions come up, however, for accidents involving business-owned vehicles while the driver is commuting to and from work, as well as situations in which the driver veers off his or her expected route.
