Whether it is a negligent driver, a careless doctor, or a store that fails to keep the premises in a condition that is safe for visitors, we know how to prove legal liability in accident cases, and we have a strong track record of results in these and other matters.

A concussion is a type of traumatic brain injury, typically caused by a blow to the head. Although they are fairly common, especially for those who play football and other contact sports, they can cause serious damage over time if a person is not given the chance to rest and heal following an accident. Symptoms are often not immediately apparent after a person sustains the injury, but they typically include headache, dizziness, nausea, or loss of memory and confusion. While these symptoms are usually temporary, a person who suffers a concussion should be monitored in the hours following the accident to check for prolonged effects that may be a product of bleeding in the brain.

Bringing a Negligence Claim to Pursue Compensation

If you have suffered a concussion or another injury in an accident, you may have the right to seek damages from those responsible. The idea is to compensate the victim for the harm. In Massachusetts, this often includes money for lost wages due to time away from work, as well as any lost earning capacity in the future that results from the accident. It also frequently includes medical expenses, pain and suffering, and emotional distress.

State law additionally allows the family members of an injured or deceased person to seek “loss of consortium” damages in certain cases. This form of legal relief is meant to compensate the family member for the loss of the victim’s companionship, support, love, and guidance.

In certain cases, an injured person may also be entitled to punitive damages. These are extra money penalties that are designed to punish a person or entity for wrongdoing. Punitive damages are generally only available in medical malpractice and wrongful death cases. They are further limited to instances in which the person or entity being sued has been found to have engaged in willful or wanton conduct or have shown reckless disregard for the health and safety of others.

In order to obtain damages, an injured person typically has to sue those responsible for negligence. Although these cases are often settled in negotiations outside of court, an accident victim should be prepared for his or her case to go through a full trial, including pretrial hearings and evidence discovery, the presentation of witness testimony and other evidence, and various related proceedings

To prove negligence, the person suing (plaintiff) has to show that the person or entity being sued (defendant) caused the plaintiff to be harmed by violating a certain duty of care. Doctors and other medical professionals owe patients an obligation to provide treatment and other services that live up to a certain professional level, based on their training and experience and the particular circumstances at hand. Car drivers are expected to operate their vehicles in a reasonably safe manner. The victim needs to tie the negligence directly to his or her injuries and provide detailed medical evidence showing that the harm resulted from the accident.
