Defects typically occur when a manufacturer fails to make the product precisely in the way that it was designed and/or the design of the product was defective. Instead, the victim must simply show that he or she was using the product as it was intended at the time of the accident, that the product was defective, and that the defect caused the victim’s injury and damages.
A person who has been hurt by a faulty product can possibly also sue the manufacturer or retailer for negligence. An entity that ships items to be sold with defects often may be liable for negligence related to any injuries the defects cause, if it is shown that the manufacturer failed to exercise “reasonable care” in designing and producing the item. In other words, the injured person has to show that the product was unreasonably dangerous and that the manufacturer knew or should have known that the product was unreasonably dangerous.
