Defective Hip Replacement Products

When you undergo hip or other joint replacement surgery, you do it with the expectation that this invasive procedure will help ease your pain and improve your quality of life. Far too many patients wind up with shoddy and defective products in their bodies, however, including some that can make a person worse off than if he or she had just skipped the surgery altogether. While the U.S. Food and Drug Administration is tasked with preventing unsafe medical devices from coming to market, many slip past government regulators only to be recalled when their harmful effects are made clear due to the injuries they cause. But recalling a hip replacement device isn’t like recalling a car or a product shoppers can find on the shelves of their local grocery store. It requires at least one more invasive surgery.

Stryker Rejuvenate and ABG II Recall

Stryker is one of the country’s major hip and joint replacement device makers. The company continues to market its wares openly, despite a previous recall and at least two stern warnings from FDA regulators. In June 2012, the company recalled its Rejuvenate Modular and ABG II modular-neck hip stems due to what it called “fretting and/or corrosion” in the implant, which Stryker said could lead to tissue damage and hip pain and swelling. Other injuries caused by defective hip replacements include:

• Hip dislocation
• Thyroid or kidney issues
• Difficulty walking
• Broken, fractured bones
• Staph infection following implant surgery

An investigation by the FDA has shown that Stryker was careless in manufacturing some of its joint replacement products and didn’t engage in the type of quality control measures – sufficient testing and clinical trials – necessary to ensure that the products were safe before selling them. Perhaps most shockingly, the government found staphylococcus bacteria throughout Stryker’s orthopedics manufacturing facility. The harmful bacteria could cause infection and even death to patients. Yet the company continues to deflect blame and has failed to take full responsibility for its disregard for patients. That leaves many of them forced to sue Stryker and other responsible parties in order to hold them liable for their careless conduct.

Product manufacturers, designers, and sellers are legally obligated to take reasonable steps to ensure that their wares are safe for use.
