Strict Liability May Apply to Child Injuries from Dog Bites
The Massachusetts dog bite law states that a dog owner is liable for bites or property damage if the injured person was not trespassing at the time or provoking the animal. This is true even if the owner had no reason to believe that the dog was prone to biting. The law applies to child injuries from dog bites and other incidents, including harm that might happen to a child who is knocked over by an aggressive dog. The damages that usually may be sought in these cases include compensation for hospital and other medical bills, the costs of therapy and any counseling that may be needed, scarring and disfigurement, and emotional distress.
The dog bite law also is particularly sympathetic to children under the age of seven. Those kids are assumed not to be trespassing and not to be provoking the animal at the time of the bite. In these situations, the burden is on the owner to prove that the injured child was on their property unlawfully at the time of the attack or was teasing, tormenting, or otherwise provoking the dog.
The state’s statute of limitations gives a person (or the parent of a person) who has been injured by a dog bite three years to file suit. The case must be filed within that time, or it is likely to be dismissed by a judge.
