Massachusetts operates under a complicated system of regulations that require road and other public works projects to include certain safety precautions. Depending on the size and scope of the project, crews may be required to use designated individuals to help direct traffic away from any potential hazards, set out traffic control equipment like lights, signs, and large orange drums, and even deploy police details in some cases. These measures are intended not only to alert drivers of the work being done, but also to control speeds in hazardous areas.
How Comparative Fault May Affect Damages
In order to establish negligence, an accident victim would need to provide detailed evidence showing the safety precautions that the crew was obligated to take, its failure to do so, how that failure contributed to the accident, and quantifiable damages that were sustained.
In some cases, a judge or jury may find that both the road crew and an injured driver were partially responsible for a crash. That may be true, for instance, in a case where a speeding driver collides with a paving truck because there was not adequate signage alerting the driver that the truck was moving slowly up ahead. Under state law, the driver can still recover some damages based on proportionate fault if he or she is deemed no more than 50 percent responsible for the crash.
