Crosswalk Accidents
Car Crash Lawyers Protecting the Rights of Cape Cod Pedestrians
At the Law Offices of John C. Manoog III, our dedicated car accident attorneys advise individuals throughout Cape Cod who have been hurt in a wide range of motor vehicle collisions. Crosswalk accidents are a particularly devastating type of crash in which an unprotected pedestrian or cyclist is struck by a moving vehicle. We understand the significant pain and stress that these accidents can cause, both for the injured person and his or her family. We have dedicated our careers to helping clients in their times of need by fighting to seek the full legal remedies that they deserve. That commitment is backed by our strong record of previous successes in other cases.
Vehicles Must Yield at Crosswalks
When a crosswalk is located in an area without a designated traffic signal, state law requires motorists to yield to people in the crosswalk. That means the driver is obligated to slow down or even stop, if necessary, to allow the crosswalk to clear. Other drivers are also barred from passing a car that has slowed or stopped to accommodate pedestrians in a crosswalk. A person who violates these laws is subject to a monetary fine and is likely to be held liable for any injuries that result. In situations where a dedicated crossing signal has been installed at the crosswalk, pedestrians are obligated to wait for the signal before entering the crosswalk.
Seeking Compensation through a Negligence Claim
Someone who causes an accident by failing to yield at a crosswalk is likely to be liable for negligence. Drivers owe others on the street a “duty of care” to operate their vehicles in a reasonably safe manner, and to refrain from aggressive and hazardous behavior like ignoring traffic signs or swerving around pedestrians in a crosswalk. In order to successfully sue for negligence, a person injured in a crosswalk accident has to prove that the driver failed to yield or otherwise acted dangerously. There must be a direct causal connection linking the driver’s carelessness to the crash.
The injured person also has to show that he or she incurred quantifiable damages as a result of the accident. This usually includes presenting medical reports and other evidence to establish costs and losses. The damages available in crosswalk accident cases often extend to money for current and future medical bills, property damage, missed wages due to time away from work, pain and suffering, and emotional distress. Additional punitive damages may be available to the victim as a way to punish a defendant for particularly callous behavior in certain extreme cases.
