Injury Lawyers Asserting the Rights of Provincetown Residents

The tenacious injury attorneys at the Law Offices of John C. Manoog III represent clients throughout the Provincetown area who have been hurt in a broad range of accidents. Having served the local community since 1994, we are highly experienced professionals who are well respected within the legal community, and who have a strong record of maximizing results for our clients. We understand the pain and stress that often comes with being in an accident, and we work tirelessly in trying to hold all responsible parties accountable for the damages that they have caused.

Located on the tip of Cape Cod, Provincetown is a charming seafaring community that traces its roots back to before the Mayflower came ashore in the town harbor in 1620. The coastal resort area’s population swells in the summer months. “P-Town” is a popular tourist destination, thanks to its inviting beaches and thriving art scene. Notable current and former residents include playwright Tennessee Williams, artist Jackson Pollock, filmmaker John Waters, and comedian Judy Gold. Provincetown also served as the setting for Norman Mailer’s 1984 novel Tough Guys Don’t Dance.

File a Negligence Claim to Seek Compensation

Whether they involve a car crash, truck accident, motorcycle collision or slip and fall, most personal injury cases arise from a claim based on negligence. This allows a victim to seek damages from the individual or company responsible for an accident. He or she would need to show that the defendant breached a duty of care owed to him or her and that this breach directly led to injuries from which quantifiable damages arose. In motor vehicle accident cases, for example, drivers are typically held to the standard of an ordinary, prudent person. They must operate their vehicles in a reasonably safe manner and are likely to be liable for any injuries that occur when they violate traffic rules or otherwise fail to use as much care as the typical person would use behind the wheel.

Massachusetts personal injury claims are subject to a three-year statute of limitations. This rule requires a victim to file suit within three years of the accident that caused his or her injuries. Otherwise, an individual will normally lose the right to seek compensation, such as money for medical expenses, costs of future treatment or rehabilitation, property damage, missed wages, pain and suffering, and emotional distress. A negligence claim generally can be filed in the area where the accident took place or where one or more of the parties involved in it lives.

Injury cases also often involve dealing with the insurance company for the defendant. State law imposes a duty of good faith on insurers as they evaluate the validity of claims and their duties under them. They must treat other parties fairly and refrain from engaging in frivolous litigation as a means of evading or reducing their responsibilities. Some insurers may not comply with this obligation, however, unless the victim enlists an aggressive lawyer to put pressure on them to act appropriately. Before agreeing to any settlement offer from an insurance company, you should make sure to seek legal guidance on whether its terms are fair to you.
