The injured person must be determined to no greater than 50 percent at fault in the accident, however, and his or her compensation award will be reduced by the degree to which he or she contributed to it.

Many vehicle crashes also include issues of third-party liability in which a person or entity other than the two drivers may also be deemed negligent. A tire maker whose defective product causes a crash by blowing out on a highway is one example. A car manufacturer whose airbags don’t deploy during a high speed truck accident is another. Under the state’s joint and several liability system, each responsible party is fully liable for all of the damages that result from an accident, regardless of how much that party contributed to it. A liable defendant ordered to pay the full amount of compensation can then seek to get some of that money back from the other responsible parties.
