Cape Cod, Massachusetts

Tenacious Injury Lawyers Serving Cape Cod Accident Victims

Nestled along the Atlantic Ocean, Cape Cod is a charming New England coastal region that attracts visitors from around the world. Originally inhabited by Native Americans of the Wampanoag tribe, the area was one of the first in the U.S. to be settled by English voyagers. It became a popular summer destination in the early 19th century, thanks to its tranquil atmosphere and easy accessibility from nearby train lines. Today, the year-round population of over 220,000 people swells with seasonal residents during the summer months. Whether you prefer to fish, bike, watch whales, or simply sunbathe on a beach, you can find a wide range of activities to enjoy during your time on the Cape. Despite the pleasant surroundings, this coastal haven can be the site of accidents and injuries to residents and visitors alike. If you have been hurt by someone else’s careless conduct on Cape Cod, the capable injury attorneys the Law Offices of John C. Manoog III can help you assert your rights.

From our offices in Hyannis and Plymouth, the lawyers at our firm have been faithfully serving clients in their community since 1994. Whether your case involves a car, bus, or truck crash, a slip and fall, or an incident of medical malpractice, we have the resources and ability to ensure that the responsible parties are held legally liable for their behavior. We help clients focus on their physical and mental recovery with the peace of mind that comes from knowing that we are fighting aggressively to pursue the compensation that they deserve.

File a Negligence Lawsuit to Seek Compensation

If you’ve been injured in an accident in Massachusetts, you may have the right to hold accountable whoever was responsible. The damages typically available in these cases include money for medical bills, missed wages for time away from work, property damage, pain and suffering, and emotional distress.

An injured person often must sue the responsible individual or entity for negligence in order to pursue these damages. To prove negligence, the victim must establish that the defendant owed him or her a duty of care. For example, a property owner generally owes visitors a duty to warn them of any hazardous conditions on the premises of which the owner knows or should be aware. An injured person also must prove that the defendant breached the duty, that this breach directly caused the accident, and that actual damages were incurred. This usually requires medical records and other evidence explaining how the harm happened and describing its extent.

In many cases, more than one defendant may be to blame for an accident. A car crash, for instance, may result from one driver’s failure to signal before making a turn and another motorist’s failure to brake in time. Massachusetts operates under a “joint and several liability” system. This means that the burden of paying damages is divided equally among any defendants held liable, regardless of how much each of them is individually at fault.

In other situations, the victim may also share some of the responsibility for an accident. The comparative negligence rule allows him or her to still recover from other liable parties based on their proportion of fault, as long as the victim is determined to be less than 50 percent responsible for the harm.
