Negligence and Other Legal Issues
Negligence is a legal theory under which a person who fails to act in a reasonably safe manner under the circumstances may be held legally liable for any injuries that he or she causes. Generally, a person suing for negligence (plaintiff) must show that the person being sued (defendant) breached a duty of care owed to the plaintiff, which – in turn – resulted in clearly identifiable injuries to the plaintiff.
Massachusetts law operates under a comparative negligence standard, requiring the injured party to show that the defendant was at least 51 percent responsible for the accident. In other words, the plaintiff has to prove that he or she isn’t more responsible for the accident (by failing to properly brake before a rear end car accident, for example) than is the person being sued (the lead driver in the rear end accident, who slammed on her brakes at the last minute). In addition, there are a number of other legal issues that an injured person should consider before filing suit. That includes the specific time limits for filing personal injury claims as well as evidence and discovery rules governing how parties to a lawsuit gather and share the information they intend to use to establish their cases.
