Products liability law makes manufacturers and sellers responsible for a wide range of harmful products allowed to reach consumers, including cars and auto parts. Many people involved in car accidents wrongly assume that the drivers may be the only ones responsible for a crash. Under state products liability law, however, cars and auto parts are sold with an implied “warranty of merchantability” which makes the retailer automatically liable for injuries caused by a defective product used in a reasonably foreseeable way.
The money damages typically available in Massachusetts car accident cases include compensation for property damage, medical bills and missed wages. To prove liability under the warranty of merchantability, you have to show that there was a specific defect in an auto part that directly contributed to the crash. That could be a problem with the way the product was designed or in the way it was actually manufactured. An auto parts maker or retailer is also on the hook if it doesn’t adequately warn users about risks associated with the product.
The injured person also has to show how the defective auto part caused the accident or made it worse. That often requires technical evidence – from expert witnesses and elsewhere – showing how the crash occurred. Even in cases where a driver is partly to blame for a collision, he or she may be able to obtain some damages via Massachusetts’ modified contributory negligence system.
