Left turn accidents often occur because the driver of a car, truck, or other vehicle simply is not aware of a motorcycle’s presence on the road. By turning into the rider’s right of way, the driver cuts off the rider’s ability to swerve or otherwise avoid the crash. The driver also sets the motorcyclist up for potentially serious – and even fatal – injuries if the rider does not have time to stop before colliding with the turning car.
Holding Negligent Drivers Accountable for Damages
A person who causes a crash by turning into oncoming traffic is likely to be found negligent if it is determined that he or she failed to take the proper precautions, such as making sure that the area was clear, before executing the turn. The law requires drivers to act in a reasonably safe manner under the circumstances, including taking additional precautions in the event of harsh weather or hazardous road conditions. A driver who fails to live up to this standard likely will be deemed negligent and is typically liable for any injuries caused as a result.
The law puts the burden of proving a driver’s negligence in left turn crash cases on an injured motorcyclist. In other words, a rider suing a driver for damages arising from the accident has to produce sufficient evidence to prove that the driver was negligent and that this negligence caused the plaintiff to suffer harm. This may require witness testimony, police reports, medical records, and expert analysis to show what happened and detail the extent of the injuries. The standard of proof is the preponderance of evidence, which means that the plaintiff’s assertions are more likely than not to be true.
In some cases, the motorcyclist may also be partly to blame for an accident. Maybe the rider was speeding at the time of the crash or made his or her injuries worse by failing to wear a helmet. In these situations, the victim can still seek to recover some of his or her damages, such as money for medical bills, missed wages, property damage, and pain and suffering, from a negligent driver if the defendant is considered to be at least 50 percent responsible for the accident and related injuries. The amount will be calibrated in proportion to the defendant’s degree of responsibility, as determined by the jury.
