Pursuing Compensation through a Negligence Claim
Although only one car might be damaged in a single-vehicle accident, these collisions are often the result of negligence by people other than the individual behind the wheel. Whether it is a careless driver who runs a red light or cuts the car off on a highway, a road crew that leaves debris and other hazardous material on the street, or a vehicle manufacturer that allows the car to leave the assembly line with defects, a person hurt in a single-vehicle accident has the right to seek legal relief from those responsible for the crash. This typically includes money damages to cover medical bills and vehicle repairs as well as missed wages due to time away from work, pain and suffering, and emotional distress.
Most single-vehicle car accident cases give rise to claims for negligence. This legal theory empowers an injured person to seek damages from those responsible for causing the harm. To prove negligence, the person suing (the plaintiff) needs to show that the person or entity being sued (the defendant) breached a “duty of care” that the defendant owed to the plaintiff. These duties may apply in all sorts of situations, including on the road. Drivers owe other drivers and passengers a duty to operate their vehicles in a reasonably safe way and to avoid dangerous activities like speeding, drinking and driving, and ignoring traffic signs. Carmakers similarly owe the public a duty to ensure that the vehicles and components they produce are in a reasonably safe condition for driving.
The plaintiff also has to prove that the breach of the duty caused the accident and that he or she incurred quantifiable damages. This usually includes gathering evidence like police reports and medical treatment records. It may also include a detailed investigation and accident reconstruction to determine just how the crash occurred. In addition to initial injuries, the medical evidence should also describe any possible future physical or mental problems the accident may cause and the treatment that will likely be necessary to address those problems.
