Holding a Negligent Driver Accountable for a Backover Accident
Backover accidents are collisions in which a car backs into – or over – another vehicle or a person. They are unfortunately a common cause of injury and even death for small children who may be difficult to see. These accidents can also happen to adults, however, particularly on construction and other work sites where workers may be crouching or kneeling behind large trucks. Backover accidents regularly occur when drivers do not take the time to adequately check before backing out of a parking space or driveway. The good news is that federal regulations require all new passenger vehicles to be equipped with rear visibility technology by 2018. The bad news is that many cars and trucks on the street today lack that capability.
A person who has been injured in a backover accident, or a parent of a child hurt in such a collision, has the right to seek damages from a driver or others who may be responsible for the harm. In many cases, this means damages for medical bills, missed wages due to time away from work, property damage, pain and suffering, and emotional distress. Sometimes, family members may also pursue “loss of consortium” damages to compensate them for the loss of the accident victim’s companionship, support, love, and guidance.
Many car accident cases revolve around claims for negligence. To prove negligence, the person suing needs to show that the driver or other party being sued failed to live up to what the law calls a “duty of care” and that this caused the victim to be hurt. Drivers generally owe others a duty to operate their vehicles in a reasonably safe manner, including by checking for people and oncoming traffic before moving out of a parking spot or driveway.
In the tragic event that a child or another person is killed in a fatal accident, the victim’s family likely has the right to sue those responsible for wrongful death. Parents, a surviving spouse, or minor children can bring a case on behalf of their loved one, alleging essentially the same claims that the deceased person would have been able to make if he or she were still alive.
